Information on potential risks of investing in crypto-assets

It is important to read and understand the risks of investing in products offered by YO ESTOY BITCOIN, S.A. DE C.V. (hereinafter, “Estoy”), which are explained in detail in this document.

A. How to interpret this risk warning?
All terms used in this notice, as defined in the Terms of Use of Estoy (the “Terms of Use”), shall have the same meaning and interpretation as in the Terms of Use.

B. Estoy Services
This notice provides information on the risks associated with Estoy Services. Each Estoy Service carries its own risks. This notice provides a general description of the risks involved in using Estoy Services and does not explain all risks or how such risks may relate to your personal circumstances. It is important to fully understand the risks before deciding to use Estoy Services. To do so, you must carefully read the Terms of Use.

C. No personal advice
Estoy does not provide personal advice regarding its products or services. It may sometimes provide objective information, transaction procedures, and information on potential risks. However, any decision to use Estoy Services is solely the responsibility of the User. No communication or information provided by Estoy is intended to be, or shall be considered as, investment advice, financial advice, business advice, or any other kind of advice. The User is solely responsible for determining whether any investment, investment strategy, or related transaction is appropriate in light of their personal investment objectives, financial situation, and risk tolerance. Estoy is not your broker, intermediary, agent, or advisor and has no fiduciary relationship or obligation with Users regarding transactions or other decisions or activities carried out using Estoy Services. Estoy does not monitor whether the use of its Services is consistent with Users’ financial goals and objectives. It is the User’s responsibility to assess whether their financial resources are suitable for their activities with Estoy and for their tolerance of the risks associated with Estoy Services.

D. No tax, regulatory, or legal advice
The taxation of crypto-assets is uncertain. The User is responsible for determining what taxes may apply and how they apply when conducting transactions through Estoy Services. It is the User’s responsibility to be informed and pay any taxes that may arise from the use of Estoy Services. Estoy does not provide legal or tax advice. Estoy recommends that Users seek independent professional advice if they have any questions regarding their tax situation, obligations arising from the use of Estoy Services, or the crypto-assets held in their Estoy Account.

E. Market risks
The value of investments and the returns obtained from them may experience significant fluctuations up and down, and the entire invested amount may be lost. Investments in early-stage projects involve a high level of risk, and it is necessary to understand their business model adequately. Trading crypto-assets is subject to high market risk and price volatility. Value changes can be significant, occurring quickly and without notice. Past performance is not a reliable indicator of future performance. The value of an investment and any return may fall as well as rise, and it is possible that you may not recover the amount invested. Crypto-assets offered by Estoy are not covered by official customer protection mechanisms such as the Deposit Guarantee Fund or the Investor Guarantee Fund. Crypto-asset prices are formed in the absence of mechanisms that ensure proper price formation, such as those present in regulated securities markets. Acceptance of crypto-assets as a means of exchange is still very limited, and there is no legal obligation to accept them.

F. Liquidity risk
Many crypto-assets may lack sufficient liquidity to exit an investment without significant losses, given that their circulation among both retail and professional investors may be very limited. This can occur at any time, even during periods of rapid price movements.

G. Fees and costs
Estoy may update fees and costs as established in the Terms of Use. All applicable costs and charges will affect any profits generated when using Estoy Services.

H. Availability risk
Estoy does not guarantee that Estoy Services will be available at all times, nor that Estoy Services will be free from unexpected service interruptions or network congestion. It may not be possible to buy, sell, store, transfer, send, or receive crypto-assets at all times. The investor does not directly hold the crypto-assets, as they are kept in Estoy digital wallets. The investor does not have access to the private keys of such wallets. The investor has the right to participate in potential gains and losses, as well as the ability to trade these assets.

I. Third-party risk
Third parties, such as payment providers, custodians, and banking partners, may be involved in the provision of Estoy Services. Users may be subject to the terms and conditions of these third parties, and Estoy will not be responsible for any loss such third parties may cause to the User.

J. Security risk
The anonymity features of crypto-assets make them a target for cybercriminals. If credentials or private keys are stolen, crypto-assets may be transferred to addresses that make recovery difficult or impossible. Estoy cannot eliminate all security risks. The User is responsible for keeping their Estoy Account password secure and for all transactions under their Estoy Account.

K. Technological risks
Crypto-assets and distributed ledger technologies are still at an early stage of development. Many of these networks have been recently created, may not be sufficiently tested, and may contain significant operational or security flaws, including but not limited to:

• Attacks on the transaction ledger of distributed networks that attempt to alter records;
• Defects, hacks, vulnerabilities, errors, protocol failures, or unforeseen circumstances affecting a crypto-asset or the technology supporting it;
• Irreversible digital asset transactions, making fraudulent or accidental losses unrecoverable;
• Technological developments leading to obsolescence of a crypto-asset;
• Settlement delays preventing timely delivery of transactions;
• Attacks on the protocol or technologies supporting a digital asset, including but not limited to distributed denial of service (DDoS), Sybil attacks, phishing, social engineering, hacking, malware, double spending, mining majority attacks, misinformation campaigns, forks, and redirection.

L. Risk monitoring
Crypto-asset markets are open 24 hours a day, 7 days a week. Rapid price changes can occur at any time, even outside of normal business hours.

M. Communication risks
Electronic communications with Estoy may fail, be delayed, insecure, or not reach their intended destination.

N. Currency risk
Fluctuations in exchange rates will affect profits and losses.

O. Legal risk
Changes in laws and regulations may significantly affect the value of crypto-assets. This risk is unpredictable and may vary from one market to another. The custody of crypto-assets involves a significant responsibility since they can be completely lost in the event of theft or loss of private keys.
